• Quality assurance, supervision, and internal audits

• Risk management and dispute resolution

• Legal and regulatory compliance

In the event that participation without recording is permitted at our sole discretion, you shall be required to execute a written informed refusal and waiver, acknowledging:

• That you are voluntarily electing to proceed without recording;

• That such absence of recording may impact continuity of care, documentation, or dispute resolution; and

• That you irrevocably waive, release, and discharge Kyvra Labs Private Limited, its directors, employees, practitioners, agents, and affiliates from any and all claims, liabilities, losses, or disputes arising directly or indirectly from the absence of such recording.

Prohibition on User Recordings

Users are strictly prohibited from recording, storing, reproducing, or distributing any session, in whole or in part, without prior written consent from Kyvra Labs Private Limited.

Any unauthorised recording or dissemination may result in:

• Immediate termination or suspension of access to the Service; and

• Appropriate legal action under applicable laws.

Data Handling, Storage, and Security

All recordings and associated Personal Data shall be:

• Processed in accordance with the DPDP Act, 2023, including principles of purpose limitation, data minimisation, and security safeguards;

• Stored using reasonable security practices and procedures as prescribed under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011;

• Accessed strictly on a need-to-know basis by authorised personnel, practitioners, or service providers bound by confidentiality obligations; and

• Retained only for as long as necessary to fulfil the purposes stated herein or as required under applicable law.

Limitation of Liability

To the fullest extent permitted under applicable law:

Kyvra Labs Private Limited shall not be liable for any claims, damages, or losses arising from:

• Your refusal to consent to recording;

• Any limitation or denial of services resulting from such refusal; or

• Any consequences arising from participation in sessions without recording (where permitted).

Subject to applicable law, you may exercise your rights as a Data Principal under the DPDP Act, including:

• The right to access information about your Personal Data;

• The right to correction and erasure;

• The right to withdraw consent; and
